Terms and Conditions

All users of this site agree that access to and use of this site are subject to the following terms and conditions and other applicable law. If you do not agree to these terms and conditions, please do not use this site.

1. Guarantee of exchange in the event of DOA: "Guaranteed Protection against Defective Items"
    All sales are final with a Guaranteed Protection against Defective Items.  An items "Warranty Period" is specified within the product details - (30 Days, 90 Days, 180 Days, 1 Year)  An exchange during the "Warranty Period" for defective items must be shipped to PCI Computers at the customers expense.  Returns of product, other than with defect, are subject to a 20% restocking fee or prevailing market rate as determined by PCI Computers. Products sold with a Manufacturer or Direct Warranty must be returned directly to the product manufacturer for repair or replacement. For these items, the warranty policy from the product manufacturer explicitly requires that any returns, repairs etc. be requested and processed directly by the consumer (or "end-user") of the item.  (A list of Manufacturer Contact Information is available at the bottom) 
2. 48 Hour Grace Period for Return
   DO NOT SHIP A RETURN WITHOUT AN RMA NUMBER. Return address may change depending on what type of defect is claimed on a product.  A unique RMA NUMBER and RETURN ADDRESS will be provided. Returns are allowed, but only within the first 48 hours after receipt, for any orders that are defective. Returns after this time period are at the complete discretion of PCI Computers and may incur a 20% restock fee due to the nature of PCI Computers low overhead warehousing procedures. Unauthorized or Unmarked returns will not be honored and may be refused upon receipt and/or shipped back at the customer’s expense. Per product descriptions, compatibility can be reasonably assured in most cases but can never be guaranteed; a product that is incompatible in a specific hardware/software environment is not therefore inherently "defective".
3. $45.00/Hour Service Fee on working parts.
   Any items sent back for warranty repair must have been tested bad - BY A QUALIFIED TECHNICIAN - prior to returning the part. We will charge a service fee of $45.00 per hour should we find a returned items to be in working condition.  Please inspect and test your products carefully prior to returning it. 
4. Please Give Details:
   Email PCIcomputercorporation@gmail.com with a description of the problem. Please be as specific as possible when listing the reason for return. This will assist us in making a correct determination of whether the product is truly defective. (Examples: “CD Rom Drive rattles and makes noises, but only after spinning for 5 minutes or more.” “Video card gives blue screen after 20 minutes”) 
5. "Damaged" Products:
   Any “dismantled”, “marked on” or “visibly defaced” product by the customer will VOID all warranties. 
6. Fitness of Purpose:
   PCI Computers cannot warrant any product as fit for any particular use or purpose. We strongly recommend customers evaluate a sample unit to determine by their criteria whether a product will work in their configuration. In the world of computers there are many products that may be incompatible with a certain brand or certain parts. In cases like this it is your responsibility to resell the product into a standard application in which the part will work. We are unable to take parts back because they will not work in particular brand product if they function correctly in others. 
7. RMA Number Must be Marked on the Outside of Box:
   RMA number must be clearly marked on the outside of the shipping box. Please included a printed copy of the RMA paperwork on the inside of the box. Customer is responsible for all shipping costs to PCI Computers. Unauthorized or Unmarked returns will not be honored and may be refused upon receipt and/or shipped back at the customer’s expense.
8. Pack Returns Carefully:
   Customer must pack defective items being returned as if they were new and working. Failure to do so may invalidate both the RMA and the warranty. PCI Computers is not responsible for goods that are damaged during shipment or misused/abused by the customer/carrier. 
9. RMA Shipping:
   Items returned to the shipping address without an RMA are considered void. You must place the RMA# provided on the outside of your package. (Prior to shipping, make sure to contact us in advance, as certain items require different RMA return addresses)  All product(s) must be return as originally received to include original packaging, manuals, documentation, and all bundled accessories. Returns must be packaged appropriately as to minimize any unnecessary damage during transit. Product(s) damaged during shipment will invalidate both the warranty and RMA and will be returned to the customer at the customer’s expense.
10. Expiration of RMA numbers:
    RMA numbers are valid for 10 days after being issued. PCI Computers must receive product within this time period (other than international returns). 
11. Out of Warranty Items:
    Items sent to PCI Computers that are OUT OF WARRANTY or DIRECT WARRANTY will only be returned to customer at customer’s expense. 
12. Credit Issued on Defective Products:
    Should a replacement for a defective item not be available, at PCI Computers discretion a suitable replacement shall be issued. If a suitable replacement is not available within 30 days from the receipt of your RMA, PCI Computers will issue a refund.
13. Direct Warranty (see manufacturer information below)

LIMITED WARRANTY 
Warranties may be limited on some items. Please check the product details page to verify the warranty is as expected. 

Replacement RMA items will be shipped back to Customer.. Express and overseas shipping is subject to an additional cost to the customer.

Limitation of Liability
PCI Computers shall not be liable for any special or consequential damages that result from the use of, or the inability to use, the materials on this site or the performance of the products, even if PCI Computers has been advised of the possibility of such damages. Applicable law may not allow the limitation of exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you.

Typographical Errors
In the event that a PCI Computers product is mistakenly listed at an incorrect price, PCI Computers reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. PCI Computers reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, PCI Computers shall issue a credit to your credit card account in the amount of the incorrect price.

Term; Termination
These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by PCI Computers without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

Notice
PCI Computers may deliver notice to you by means of e-mail, a general notice on the site, or by other reliable method to the address you have provided to PCI Computers.

Miscellaneous
Your use of this site shall be governed in all respects by the laws of the state of California, U.S.A., without regard to choice of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of PCI Computers products) shall be in the state or federal courts located in Los Angeles County, California. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of PCI Computers products) must be commenced within one (1) year after the claim or cause of action arises. PCI Computers's failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. PCI Computers may assign its rights and duties under this Agreement to any party at any time without notice to you.

Use of Site
Harassment in any manner or form on the site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including a PCI Computers or other licensed employee, host, or representative, as well as other members or visitors on the site is prohibited. You may not upload to, distribute, or otherwise publish through the site any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law. You may not upload commercial content on the site or use the site to solicit others to join or become members of any other commercial online service or other organization.

Participation Disclaimer
PCI Computers does not and cannot review all communications and materials posted to or created by users accessing the site, and is not in any manner responsible for the content of these communications and materials. You acknowledge that by providing you with the ability to view and distribute user-generated content on the site, PCI Computers is merely acting as a passive conduit for such distribution and is not undertaking any obligation or liability relating to any contents or activities on the site. However, PCI Computers reserves the right to block or remove communications or materials that it determines to be (a) abusive, defamatory, or obscene, (b) fraudulent, deceptive, or misleading, (c) in violation of a copyright, trademark or; other intellectual property right of another or (d) offensive or otherwise unacceptable to PCI Computers in its sole discretion.

Indemnification
You agree to indemnify, defend, and hold harmless PCI Computers, its officers, directors, employees, agents, licensors and suppliers (collectively the "Service Providers") from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site using your Internet account.

Third-Party Links
In an attempt to provide increased value to our visitors, PCI Computers may link to sites operated by third parties. However, even if the third party is affiliated with PCI Computers, PCI Computers has no control over these linked sites, all of which have separate privacy and data collection practices, independent of PCI Computers. These linked sites are only for your convenience and therefore you access them at your own risk. Nonetheless, PCI Computers seeks to protect the integrity of its web site and the links placed upon it and therefore requests any feedback on not only its own site, but for sites it links to as well (including if a specific link does not work).

PCI Computers.com strives to be as accurate as possible in our content and pricing. In the event a product is listed with an error in pricing or incorrect content, PCI Computers.com shall have the right to refuse or cancel any order whether or not the order has been confirmed and credit card charged. In the event that a credit card has already been charged and an order subsequently canceled, PCI Computers.com will issue a refund to the credit card account in the amount of the charge.
